September 27, 2004


The city council approves a contract with SMG to manage the Genesee Theatre, for compensation of $10,000 per month through May 1, 2005, and $9,000 per month thereafter until July 31, 2005.

Ray Vukovich publicly admits that Jimmy's Charhouse will not be opening a heavily-subsidized restaurant across from the Genesee Theatre, confirming rumors to that effect.


October 2, 2004


The city announces that the Genesee Theatre will open on December 3, 2004, with the first act to be unveiled on October 12.


October 12, 2004


The announcement is made that Bill Cosby will be featured in a two-performance, one-day opening act for the Genesee Theatre on December 3, 2004.

Future programming is yet to be announced.


October 14, 2004


TOWN completes its review of the Genesee Theatre renovation records and documents furnished by the city and is unable to find:

(a) Any amendment, change order, or construction change directive that modified the contract sum or contract time on either Pickus contract (TOWN did find a series of Architect's Supplemental Instructions that expressly stated that they made no change in the contract sum or contract time).

(b) Any performance bond for the first Pickus contract (although the City Attorney indicated in a letter that Pickus may have endorsed the Genesee Theatre project into some "existing compendium bond and insurance coverage" that was exempt from production pursuant to a FOIA request).

(c) Any written contract or extension of contract between the city and Pickus to cover the 4½ month period between mid-June of 2003 (when the first construction contract required the project to be completed) and the city council resolution on November 3, 2003 to enter into a second contract with Pickus.

(d) Any written contract or extension of contract between the city and Pickus to cover the 5½ month period between the November 3, 2003 resolution of the city council and the second Pickus contract of April 19, 2004.

(e) Any written contract or extension of contract with Pickus to cover the construction still underway (as of the date of this report), which the second Pickus contract required to be substantially completed by September 15, 2004.
